THESE TERMS AND CONDITIONS APPLY TO ALL BOOKINGS FOR Brain & Neuroplasticity courses STARTING ON OR AFTER 1ST may 2019.
Definitions: In these terms and conditions, the following terms have the meanings set out next to them (and references to the singular include the plural and vice-versa). Brain & Neuroplasticity is a Chiropractie Leiden B.V. label, used for its functional neurology seminars.
Agreement: These terms and conditions together with the Registration Form which is supplied by Chiropractie Leiden B.V./Brain & Neuroplasticity at the time of registration.
Application Form: The digital form you complete and send to Chiropractie Leiden B.V. / Brain & Neuroplasticity in connection with applying for a place on a Course which shall be considered to form an integral part of this Agreement.
Confirmation Form: The digital form Chiropractie Leiden B.V./Brain & Neuroplasticity sends you to confirm acceptance of your application.
Seminar: The Seminar of study you have applied for on your RegistrationForm offered by Chiropractie Leiden B.V./Brain & Neuroplastictiy.
Departure Date: The date on which your Course ends.
Brain & Neuroplasticity: The Seminar venue at various locations identified on the website.
Start Date: The first day of the Seminar for which you are applying.
Brain & Neuroplasticity: The location where you wish to study identified on the website.
Website: The website at www.brain-neuroplasticity.com
You/Your: The applicant for a Course at Chiropractie Leiden B.V./Brain & Neuroplasticity.
1. Agreement
This Agreement shall be legally binding between you and Chiropractie Leiden B.V./Brain & Neuroplasticity once Chiropractie Leiden B.V./Brain & Neuroplasticity has received a completed Registration Form from you, whether by e-mail or otherwise, and has confirmed your place by sending you a Confirmation Form. This Agreement and any dispute or claim arising out of or in connection with it or its validity or its subject matter or formation is governed by and construed and interpreted in accordance with the laws of the legal jurisdiction in which Chiropractie Leiden B.V./Brain & Neuroplasticity is situated.
2. Seminars
Start Dates are detailed on the website. In the event of an insufficient number of students booking for a particular Seminar, Chiropractie Leiden B.V./Brain & Neuroplasticity reserves the right to cancel the Seminar or provide you with an alternative Seminar which Chiropractie Leiden B.V./Brain & Neuroplasticity, in its sole discretion, considers suitable.
3. Entrance Level
Our Seminars are designed for chiropractic graduates and undergraduates. Other disciplines are also welcome to our Seminars, but they are asked to contact us and send us a request to participate before registration. Failure to do so may result in you being unable to take the Seminar requested.
4. Seminar Times
Indicative Seminar times are set out on the Website. Chiropractie Leiden B.V./Brain & Neuroplasticity reserves the right to alter such Seminar times at its discretion before the commencement of any Seminar.
5. Certification & Attendance
You must attend a minimum of 80% of scheduled time for the Seminar in order to receive a certificate of attendance at its conclusion. Participants whose attendance falls below this level may not receive the certification of attendance. All certificates must be collected at the Seminar venue. We will gladly post the certificate in the mail or send a digital pdf version at the and extra administration fee of Euro. 15,-
6. Cancellations
You may cancel your booking to one of our Seminars, provided you do so by written notice to Brain & Neuroplasticity’ registrar, which it must receive not less than 14 days before the Start Date. In such an event, any fees you have paid will be refunded except for a cancellation fee of €50. registrar@brain-neuroplasticity.com
Alternatively, you will can also transfer the registration of a particular Seminar to another Seminar within one calendar year, providing you notify us 14 days before the Start Date of the Seminar you are unable to attend. In this case we will apply an administration fee of Euro. 15.
If you cancel your booking less than 7 days before the Start Date, no refunds will be issued under any circumstances. If you terminate a Seminar after the Start Date, or if you fail to present yourself at the seminar venue on the Start Date without having previously cancelled your Seminar, no refunds will be given. Chiropractie Leiden B.V./Brain & Neuroplasticity is not obligated to supply the participant for any missed seminar course materials that the participant has not been able to attend.
Registrations to the Chiropractie Leiden B.V./Brain & Neuroplasticity seminars require 100% of the total fee to be paid in advance before the seminar begins.
7. Changes and Amendments
Once you have started a Seminar, no changes may be made to it other than by written agreement from Chiropractie Leiden B.V./Brain & Neuroplasticity. If Chiropractie Leiden B.V./Brain & Neuroplasticity opts to approve a change, the additional charge, which will be specified, will be incurred by you and no change can be effected until full payment has been received.
8. Prices
All prices stated on the Website are valid till 1 July 2020. Chiropractie Leiden B.V./Brain & Neuroplasticity reserve the right to unilaterally change prices as a result of governmental regulations, tax increases, exchange rate variations or other events. Seminar catering and material expenses are included in the course fee.
9. Registration & Payment
Full payment must be received by Chiropractie Leiden B.V./Brain & Neuroplasticity at the time of registration. You will not be allowed to commence your Seminar if payment is not made by that time. Payment may be made by bank transfer (see below), Paypal or several electronic alternatives.

Chiropractie Leiden B.V./Brain & Neuroplasticity will not incur any fees related to international bank transfers. All costs are at the expense of the participant and their own bank.
At the time of registration and payment, a payment receipt will be automatically generated by our website, based on the information provided by you. You will receive this payment receipt in the emailbox given by you during the registration procedure.
If you require an additional copy of this payment receipt, or a paper copy sent to you in the mail, you will be charged and additional Euro. 15,- administration costs.
10. Descriptions
Chiropractie Leiden B.V./Brain & Neuroplasticity honestly believes that all statements made in promotional material are factual and correct. Every reasonable effort has been made to ensure such accuracy. Chiropractie Leiden B.V./Brain & Neuroplasticity is not responsible for any changes that become known after promotional material is produced (up to date information can be found on the Website. Chiropractie Leiden B.V./Brain & Neuroplasticity will advise you of any material changes which become known to it prior to the Start Date.
11. Conduct
You are expected to behave in a courteous manner and to respect fellow participants and staff at Chiropractie Leiden B.V./Brain & Neuroplasticity. The illegal use of drugs, alcohol abuse and inconsiderate behaviour is unacceptable as is any failure by you to abide by the law and custom of Chiropractie Leiden B.V./Brain & Neuroplasticity location. Chiropractie Leiden B.V./Brain & Neuroplasticity reserves the right to withhold Courses from any participant who fails to meet such standards and to terminate any Course or part thereof without refund in appropriate circumstances.
12. Insurance and Liability
Chiropractie Leiden B.V./Brain & Neuroplasticity shall not have any liability to you for any loss of possessions, injury, death, costs related to medical or dental treatment, or costs related to repatriation or for any other losses, damages (whether direct or indirect), compensation, costs or expenses unless negligence can be proved in a court of law in the jurisdiction of Chiropractie Leiden B.V./Brain & Neuroplasticity. Chiropractie Leiden B.V./Brain & Neuroplasticity shall not have any liability to you for any loss, damage, costs, expenses or other claims for compensation arising from any information or instructions supplied by you which is, or are incomplete, incorrect or inaccurate. Where Chiropractie Leiden B.V./Brain & Neuroplasticity incurs costs due to incomplete, incorrect or inaccurate information, the participant will be liable for these extra costs. Nothing in any agreement you have with Chiropractie Leiden B.V./Brain & Neuroplasticity affects any liability for death or personal injury caused by Chiropractie Leiden B.V./Brain & Neuroplasticity negligence or for fraudulent misrepresentation, or your statutory rights as a consumer.
13. Matters beyond Chiropractie Leiden B.V./Brain & Neuroplasticity control
Chiropractie Leiden B.V./Brain & Neuroplasticity will endeavour to provide you with the Course and service you book. However, we do not take responsibility for disruptions to the Course and arrangements associated with it resulting from forces out of Chiropractie Leiden B.V./Brain & Neuroplasticity control, such as (but not limited to) earthquakes, other natural disasters, war, governmental action and the like. Refunds in respect of the curtailment of the Course or the period of your stay in Chiropractie Leiden B.V./Brain & Neuroplasticity location will not be made in such circumstances. Participants are responsible for their own personal belongings. Chiropractie Leiden B.V./Brain & Neuroplasticity will not be held responsible for stolen, lost or damaged items belonging to participants.
14. Photography, Filming & Sound Recording
During the Seminar, Chiropractie Leiden B.V./Brain & Neuroplasticity may arrange to record, photograph or shoot video footage for its promotional purposes only, both printed and online. Any participant who does not wish to participate should indicate this on their arrival to a Seminar and state it again at the time of the recording, photographing or video shooting the wish not to participate.
Subsequently, participants will not be allowed to photograph, film nor sound record any part of the Seminar.
15. Complaints Procedure
Chiropractie Leiden B.V./Brain & Neuroplasticity is committed to providing a quality service for its members and working in an open and accountable way that builds the trust and respect of all. One of the ways in which we can continue to improve our service is by listening and responding to the views of our participants in particular by responding positively to complaints, and by putting mistakes right.
Therefore we aim to ensure that by
•making a complaint is as easy as possible;
•we treat a complaint as a clear expression of dissatisfaction with our service which calls for an immediate response;
•we deal with it promptly, politely and confidentially;
•we respond in the right way – for example, with an explanation, or an apology where we have got things wrong, or information on any action taken etc;
•we learn from complaints, use them to improve our service, and review annually our complaints policy and procedures.
We recognise that many concerns will be raised informally, and dealt with quickly. Our aims are to:
• resolve informal concerns quickly;
• keep matters low-key;
• enable mediation between the complainant and the individual to whom the complaint has been referred.
An informal approach is appropriate when it can be achieved. But if concerns cannot be satisfactorily resolved informally, then the formal complaints procedure should be followed.

You can expect your complaint to be acknowledged within 4 working days of receipt. You should get a response and an explanation within 15 working days
A written complaint is to meet a number of formal requirements. In your letter you should set out the details of your complaint, the consequences for you as a result, and the remedy you are seeking.
The complaint is reviewed by Chiropractie Leiden B.V./Brain & Neuroplasticity’s complaints committee within 14 days of the date on which the complaint is received. Within this time, an opportunity is given to both the complainant and the accused to orally elaborate their positions. The complaints committee will then lay down its findings in a written piece. Chiropractie Leiden B.V./Brain & Neuroplasticity’s Executive Board subsequently comes to a decision on dealing with the complaint, basing itself on this written adviceI. f you are not satisfied with the initial response to the complaint then you can address a letter to Chiropractie Leiden B.V./Brain & Neuroplasticity’s CEO Jeroen J.J. Postma and ask for your complaint and the response to be reviewed. You can expect the CEO to acknowledge your request within 4 working days of receipt and a response within 15 workings days.
If you are not satisfied with the subsequent reply from Chiropractie Leiden B.V./Brain & Neuroplasticity’s CEO, then you have the option of writing to Quasir, a certified and independent organism that deals with complaints in the Netherlands: www.quasir.nl
The decision by Quasir is final.
A complaint is to be submitted within one year after the action that is the subject of the complaint occurred. The Chiropractie Leiden B.V./Brain & Neuroplasticity s not held to consider a complaint submitted after this termand will do so in extraordinary cases only.
Chiropractie Leiden B.V./Brain & Neuroplasticity’s aim is to resolve all matters as quickly as possible. However, inevitably some issues will be morecomplex and therefore may require longer to be fully investigated. Consequently timescales given for handling and responding to complaints are indicative. If a matter requires more detailed investigation, you will receive an interim response describing what is being done to deal with the matter, and when a full reply can be expected and from whom.
The complaints procedure is based on Dutch laws and regulations, including the General Administrative Law Act, several codes of conduct and Chiropractie Leiden B.V./Brain & Neuroplasticity Complaints Procedure which is public.
The persons and companies named in this Complaints Procedure are real. The Complaints will be handled respecting European Privacy Laws and its procedures will be kept on file for a minimum of 7 years.
